By placing an order, you acknowledge and agree to be bound by these Terms and Conditions. This constitutes a legally binding agreement between you (the “Customers”) and DK & K SERVICES LIMITED, trading as Professional Gardening Services (the “Supplier” or “we”), a company registered in England and Wales under company number 10198193, with its registered office at Flat B 17 Priory Gardens, London, W5 1DX. - Application
- These Terms and Conditions govern the provision of gardening services by us to you. By placing an order, you confirm that you have read, understood, and agreed to these Terms and Conditions.
2. Interpretation
- “Customer” refers to an individual acting outside their trade, business, craft, or profession.
- “Contract/Quote acceptance” means the legally binding agreement between the Customer and the Supplier.
- “Service Location” refers to the location where the gardening services are to be provided, as specified in the order.
- “Services” encompass the gardening and related services provided by us (the “Supplier”) , as outlined in the order.
- “Order/Booking” denotes the Customer’s request for gardening services.
3. Services/Bookings
- Descriptions of services provided on our website, brochures, or advertisements are for reference only. Variations may occur based on site conditions.
- The customer’s can book our services from our website in a multiple ways. Directly from our automated booking system, call us on 07492 657 585 or drop us an email on [email protected]
- If services are tailored to your specific requirements, you are responsible for ensuring the accuracy of provided information.
- All services are subject to availability, and we reserve the right to modify them if required to comply with legal or safety standards. Any changes will be communicated to you.
4. Customer Responsibilities You agree to:
- Cooperate with us in all matters related to the gardening services.
- Provide our team with access to necessary premises.
- Supply accurate information required for service completion.
- Obtain any necessary permits or consents, unless otherwise agreed.
Failure to comply with the above may result in suspension or termination of services without refund.
5. Basis of Sale
- Our service descriptions do not constitute a contractual offer.
- We reserve the right to reject any order at our discretion. If accepted, a binding contract is formed when we confirm your order via email or begin providing the services.
- Price estimates are valid for 7 days unless withdrawn earlier.
- Any changes to the contract must be agreed upon in writing by both parties.
6. Booking Fees and Payment
- Service fees and any additional costs are as per our current price list on our website.
- Fees include VAT where applicable.
- Full payment is required in advance to confirm and schedule your gardening service.
- Payment must be made via the secure link provided in our invoice.
- If access to the property is not provided as agreed, full payment will be retained as compensation for lost time and income.
7. Provision of Gardening Services
- We will provide gardening services within a reasonable timeframe or as agreed.
- Services must be examined upon completion. If any issues arise, they must be reported immediately.
- We do not typically provide services outside England. If an international request is accepted, additional costs may apply.
8. Risk and Responsibility
- Responsibility for the completed gardening services passes to you upon completion.
- Ownership of any materials used in the service remains with us until full payment is received.
- In cases of non-payment, we may reclaim any supplied materials or cancel future services.
9. Cancellation and Refund Policy
- Bookings may be cancelled within 48 hours of contract formation, except for customised services.
- Cancellations made within 24-48 hours of the appointment will incur a 50% charge.
- Cancellations within 24 hours, failure to provide access, or refusal of service will be charged in full.
- Refunds will be processed promptly for eligible cancellations, excluding any service fees already incurred.
- If payment is made after it’s due date the company (the “Supplier”) reserves the rights to withhold that payment as a compensation for loss of earnings. A new booking will be required, subject to availability and additional charges.
10. Service Standards and Compliance
- We are legally obligated to provide services with reasonable skill and care.
- Services must conform to their description and be fit for their intended purpose.
- Any failure to conform due to customer-provided materials will not be our responsibility.
11. Termination and Suspension
- Either party may terminate the contract if the other commits a material breach or becomes insolvent.
12. Privacy and Data Protection
- We comply with GDPR in processing personal data.
- Personal data is collected for service provision and will not be used beyond identified purposes.
- We implement technical and organisational measures to safeguard your data.
13. Governing Law and Disputes
- These Terms and Conditions are governed by the laws of England and Wales.
- Disputes will be handled through negotiation. If unresolved, they may be escalated to the courts of England, Wales, Scotland, or Northern Ireland, depending on the Customer’s location.
14. Additional Provisions
- Quote Validity: Quotes are valid for 7 days.
- Transparent Pricing: Prices are final unless additional work is requested.
- Revisions to Quotes: One free quote is provided; subsequent amendments incur a £60 fee.
- Parking Requirements: Customers must provide a valid parking permit; otherwise, costs will be added to the final invoice.
- Marketing & Photography: We may take before-and-after photos for promotional use unless otherwise requested in writing.
- Acceptance of Terms: By confirming an order/booking, you acknowledge and accept these Terms and Conditions.
15. Liability and Warranties
- The Company takes reasonable care in providing services but is not liable for pre-existing damages to plants, property, or outdoor and indoor structures and furniture.
- We do not guarantee the success or longevity of plant growth or landscaping features due to external factors beyond our control (e.g., weather, soil conditions).
- Customers must notify us of any concerns within 48 hours of service completion.
- Customers must inform us of any potential hazards, such as underground cables or pipes, before work begins.
- We reserve the right to refuse service if conditions pose a risk to health and safety.
- We are not liable for delays or failure to provide services due to events beyond our control, such as extreme weather, natural disasters, or public emergencies.
16. Complaints and Dispute Resolution
- Customers should report any issues within 48 hours of service completion.
- We will investigate and aim to resolve complaints within 7 working days.
- If a resolution cannot be reached, disputes will be handled through mediation or legal action if necessary.
